Widmer sheds light on a neglected aspect of the Western philosophical tradition. Following an era of Hegelianism, the members of the neo-Kantian "Marburg School," such as Friedrich Albert Lange, Hermann Cohen, Rudolf Stammler, Paul Natorp, and Ernst Cassirer defended socialism or left-wing ideals on Kantian principles. In doing so, Widmer breaks with two mistaken assumptions. First, Widmer demonstrates that the left-Hegelian and Marxist traditions were not the only significant philosophical sources of socialist critique in nineteenth-century Germany, as the left-Kantians identified (...) problems of normativity that the left-Hegelians could not adequately address. Second, Widmer challenges the prevailing assumption that the political philosophies developed in the Marburg School can be comprehensively characterized as a unified school of "ethical socialism." By showing that they varied fundamentally regarding their political views and their philosophical foundations of socialism, Widmer fills a gap in the studies of neo-Kantianism that is long overdue. Polygamy is a highly controversial topic and the object of serious political contestation in Indonesia. Although all major Muslim organizations consider polygamy is allowed under Islamic Law, the practice is not without stigma. In 1974 when Indonesia adopted its current Marriage Law, the Indonesian parliament decided to tie polygamy to strict conditions. This law however failed to prevent the practice of unregistered polygamous marriages. Women in unregistered polygamous marriages formally hold no rights as lawful wife in case of a divorce (...) or death of the husband. The question is what arrangements the second, third or fourth wife in unregistered polygamous marriages have made with their husband in view of the lack of legal recognition of their rights as wife. What are the consequences of non-recognition of their marriage for these women? Does legal insecurity in practice also mean economic and social insecurity? Does the husband fulfill his obligations and responsibilities towards his wives and their families? This article aims at answering those questions by looking in-depth at a selection of three case studies, which were collected during a total of nine months of research in Jakarta in 2015 and 2016. This article is part of the socio-legal domain, combining legal analysis with anthropological approaches. The starting point of the research is a legal one: the disadvantaged legal position of women whose polygamous marriage has not been registered, but a large part of the research is based on anthropological methods. Through the experiences of these women the paper will reveal a range of personal reasons and underlying causes for unregistered Islamic polygamous marriages as well as their consequences–including legal ones. The paper will depict a great diversity in legal reasoning, socio-economic considerations, religious reflections and daily life dilemmas of these individual women living in unregistered polygamous marriages. With his victories over Carthage (146 BC) and Numantia (133 BC), Scipio Aemilianus contributed significantly to the establishment of Rome’s unchallenged rule in the Mediterranean. The article analyses and compares Scipio’s military action in the conquest of the two cities under the aspect of temporality and places the results in a temporal-structural framework. Due to the requirements of the cursus honorum, Roman commanders in the Middle Republic had a narrow window of opportunity to generate military glory. The violent actions of (...) Roman commanders were less subject to tactical considerations related to the opponent, but were rather guided by a Rome-related calculation that was oriented towards the politically constructed time constraints of the Republic. With the help of a temporal approach, a new view of the dynamics of Roman expansion can be gained. (shrink)

In recent literature, it has been suggested that Lange’s social and political philosophy is separate from his neo-Kantian program. Prima facie, this interpretation makes sense given that Lange argues for an account of social norms that builds on Darwin and Smith rather than on Kant. Still, this paper argues that elements of psychophysiological transcendentalism can be found in Lange’s social and political philosophy. A detailed examination of the second edition of the History of Materialism, Schiller’s Poems, and the second edition (...) of The Worker’s Question reveals that Lange sought to develop a systematic foundation of psychophysiological transcendentalism that is presupposed in his social and political philosophy. This allows for a more detailed understanding of Lange’s practical philosophy and assures him a position in the tradition of neo-Kantian socialism. (shrink)

Unlike Johann Benjamin Erhard’s views on art, right, revolution, and structural misrecognition, his discussion of economic injustice, here understood as the lawful economic oppression of one’s end-setting human nature, has garnered little attention. To begin filling this gap, I focus on central passages from his 1795 book On the Right of the People to a Revolution wherein Erhard discusses two cases of economic injustice. By reconstructing these claims within his Kantian perfectionist framework, I pursue two goals. First, I seek to (...) demonstrate that his fundamental ‘duty to oneself’ lays out a comprehensive framework for duties grounding moral obligations to remedy economic practices. My second aim is to utilize this framework to explain how he defends a natural law position that views the legal system as both a remedy for and an ideological tool of economic oppression. I argue that this twofold perspective is a strength of Erhard’s theory as it allows for the detection of oppressive economic structures without letting go of a principle of external freedom from where coercive juridical laws can be derived. Cassirer’s view on ethical objectivity is puzzling. In his scarce comments on Kantian ethics, he defines the “pure will” as a “function of consciousness,” which he considers a prerequisite for the possibility of objective ethical normativity embedded in empirical reality. In the existing body of literature, we find two different interpretations of Cassirer’s account of ethical objectivity. The “meta-philosophical” interpretation takes objectivity as a telos that humanity gradually approaches, thereby emphasizing the historically relative truth standards to which the teleologically-evolving symbolic (...) forms respond. The “Kantian” interpretation takes objectivity as a concept inherent to the conduct of the moral law, highlighting the evaluative and prescriptive aspects of his philosophical method. In this paper, I defend the thesis that, by interpreting Cassirer’s ethics through the lens of Hermann Cohen’s mature ethical theory, we can see that ethical deliberation in Cassirer involves a notion of universality that is a priori and depends on a substantiated concept susceptible to change. The proposed “contingent conception of universality” thesis accounts for both: the evaluative and teleological features of Cassirer’s ethical theory, grounding an a priori account of ethical objectivity conceptualized relative to contingent truth standards that gradually improve. Hermann Cohen, the founding father of Marburg neo-Kantianism, is known for criticising capitalism from a Kantian ethical perspective. Thus far, the role of the notion of humanity in this critique has been viewed as grounding what I shall call the ‘purposive labour reading’. This reading takes Cohen’s primary interest to lie in a reorganisation of work so that our humanity, which requires us to be treated as ends, remains intact. With the aim to better understand the relevant notion of humanity, (...) I contextualise the discussion within the overall framework of Cohens’ neo-Kantian account of ethical cognition and situate his ideas in the context of his contemporary interlocutors. Revisiting Cohen’s remarks on socialism and capitalism against this backdrop reveals that his discussion of labour serves as an exemplar, showcasing how ethical rationality manifests in the liberal socialists’ demands. I argue that his primary aim was not to prepare the ground for a prescriptive labour theory – though this is likely to follow – but to argue for a framework alternative to historical materialism, allowing us to perceive and interpret social practices in an ethical light. This initial volume of the Collected Works of Edith Stein offers, for the first time in English, the unabridged biography of Edith Stein (Teresa Benedicta of the Cross), depicting her life as a child and young adult. Her text ends abruptly because the Nazi SS arrested, then deported, her to the Auschwitz concentration camp in 1942. Edith Stein is one of the most significant German women of the 20th century. At the age of twenty-five she became the first assistant (...) to Edmund Husserl, the founder of Phenomenology. She was much in demand as a writer and lecturer after her conversion from atheism to Catholicism. Later, as a Discalced Carmelite nun, she maintained her intellectual pursuits until she, like so many others, became a victim of the Nazi persecution that raged across Eastern Europe. By making this landmark work available in English, the Institute of Carmelite Studies provides an eye-witness account of persons and activities on the scene at the time when psychology and philosophy became separate disciplines. In addition to photographs and a map, this volume is enhanced with a preface, the foreword and afterword, notes, and a list of places associated with Edith Stein’s life. It is our aim that these, together with Edith Stein’s text, may help bring into relief the many background details of the rich autobiographical work she has left us. (shrink)

This newly revised edition of Edith Stein’s collected essays on woman is a valuable text. It contains two significant changes from the first edition. The first is a recently discovered addition of sixteen more pages to the essay “Spirituality of Christian Woman,” while the second is the deletion of an address now believed to have been falsely ascribed to Stein entitled “Challenges Facing Swiss Catholic Academic Women.” In addition, the typeface has been changed to a more readable style.

The widespread view — proclaimed by proponents of disability studies, some disability federations, and many disabled people — that there is a human right to inclusive education, was eventually substantiated by international law with the UN Disability Convention in 2006. One of the most discussed issues in disability studies concerns the CRPD; the contributions are legion. Surprisingly, there are hardly any substantial contributions that pay particular attention to the important question of whether inclusive education is a moral human right, and, (...) if so, how this particular human right could be morally justified. A related topic that is frequently discussed concerns the question of whether inclusive education is compatible with the International Bill of Human Rights. Other scholars, such as Theresia Degener, wholeheartedly support the idea that inclusive education is a substantial legal and moral human right. (shrink)

Natural law as a discipline was definitively institutionalized at universities in the Habsburg monarchy during the reforms of Maria Theresia after 1752. The guiding principles of these reforms were set in the instruction for the chair of natural law in Vienna which was given to Carl Anton Martini. It was Catholic in conception, but it ordered the professor to draw on Grotius. Our article reconstructs the elementary structure of Martini’s theory of natural law with a focus on his conception (...) of state. The article proves that Martini did not adopt Wolff’s conception of deducing duties and obligations from the highest principle for that would conflict with the Catholic emphasis on freedom of will. Instead of that, Martini derived duties and rights from the three God-given ends. Martini perceived the state as based on social contract, after the model of Christian Wolff. However, it seems that Martini rejected the two-contract model and acknowledged only the contract of submission as binding. Martini sought to hold the middle ground between Machiavellians arguing that the subjects lose all rights after the social contract, and radical ‘monarchomachs’ who believe that the ‘populus’ retains the supreme power. Martini argues that the ruler is limited by natural laws; the subjects retain rights to life and to property, but they are denied any right to resistance. Since Martini derived the monarch’s powers from the unlimited duty to guarantee security, he admitted even encroachments on religious freedom. He admitted coercion in matters that would threaten salus civitatis, but respected the inner libertas conscientiae. He also acknowledged a peculiar division of powers differentiating between a legislative, an inspectorial and an executive power. Even though the aim of this division was not a system of checks and balances, a precise description of the scope of the executive power helped to delimit a sphere of individual freedom. (shrink)

It seems impossible to completely cover the field indicated by the title of this report because of the many contributions of individual physicians and non-physicians to problems of the philosophy of medicine in Austria, and to their solution. The main trends are rooted in historic developments and in the current problems of medicine and health care, which are similar world-wide. In Austria famous names like empress Maria Theresia or the physician Ignaz Semmelweis have to be mentioned in connection with (...) the development of the ideas of a philosophy of medicine. In recent times again influential and well-known persons in related fields of medicine and health care are Austrians. However, the main line of new developments goes mostly unseen by the public: activities in medical ethics with the goal to humanize health care, carried on by groups of young physicians, biomedical engineers and students. This essay discusses the question of health in the Kingdom of Hungary during the Age of Enlightenment. It explores the relationships and tensions between central theories of medical police and the local expectations of government administrators, as well as those between academic or official knowledge and implicit or alternative knowledge about health. The reigns of Maria Theresia and Joseph II marked the moment at which particular kinds of folk and practical knowledge about healing became visible and above all legible. (...) This is to be seen in the enormous rise in book production, which in itself represented an ‘approved knowledge’ that found legitimation in new academic and bureaucratic institutions, such as the reformed medical faculty of the University of Vienna, the newly-founded medical faculty at Tyrnau, the establishment of a health department within the Hungarian Statthalterei, as well as in the emission of royal legislation supporting the agendas of the new enlightened science of ‘medical police’. This volume claims to examine Thomas's work and influence in light of the newest research. This is very true of Wielockx's article, but not every contribution equally justifies this claim. Still, this collection is a welcome addition to the ongoing investigation of Thomas's (...) thought. It is all the more regrettable, then, that the publishers have decided upon such an exhorbitant price, apparently resigning themselves to the belief that there is no market for the book outside libraries which have already ordered the series. Doctor Freda Mary Oben is well qualified to interpret Stein's writings as she, like Edith Stein, is a convert from Judaism to Catholicism and a scholar as well. She began to study Edith Stein after her conversion but }lad to learn German to do it. Essays on Woman is a testimonial to Oben's nearly 30year enterprise. This work is a translation of Die Frau, Ihre Aufgabe nach Natur und Gnade, which contains Edith Stein's lectures and writings on woman, compiled and edited by Dr. L. Gelber and Romaeus Leuven, O.C.D., of the Archivum Carmelitanum Edith Stein in Brussels. These two works can be read in either order, as each supports and elucidates the other, but for an introduction, Edith Stein: Scholar, Feminist, Saint should be read first. Since Oben refers to Stein as Edith in this work, this reviewer will do the same. 380 BOOK REVIEWS The Edith Stein work consists of three chapters. Chapter One is a 37-page, well-documented biography supported by quotations from Edith's writings. Oben's straightforward, lucid style enhances this compact account of the variety of interesting, inspiring, and gripping details of Edith's life. Oben recounts her own tour of the significant places in Edith's life: Breslau, Gottingen, Bergzabern, Speyer, Miinster, Cologne, Echt, Auschwitz. The narrative is supplemented with eight pages of Stein family photographs in the middle of the book. Throughout her life, Edith Stein maintained a strong love for her family and her own Jewish people. Integrated with this is the develop· ment and growth of her intellectual life: from an ambivalence toward school to her being among the first women to enter a university to her becoming a university professor, all the while struggling from being at first unable to pray to later working among scholars who were deep· ly spiritual. Several of these scholars were converts from Judaism to Christianity and even to Catholicism. Oben shows how, once a Catholic, Edith used her intellectual ability to study the link between woman's nature and religious education. By 1932 Edith was recognized as the intellectual leader of Catholic feminism in Europe. The paper proves that a historical method in Marxism is not identified to a dialectical method. The logic of history and the logic of its analysis in Marxism do not always coincide. The Logical coincides with the Historical only in eternity as it actually occurs in the works by G.V.F. Hegel. Eternity which has already witnessed everything does not know history any more. In the same way, history also begins there where the eternity comes to an end. Therefore, artificial identification (...) of the Logical with the Historical in Marxism led sometimes to actual mistakes. It is no wonder that it has always caused discussions in Marxism. They are mainly explained by the fact that the deductive, abstract-to-concrete method in which the “General” appears before the “Concrete” is an anti-historical method in its Nature. In real human history the “General” which is generalization of many “Concrete” could not appear before the latter in any way. For this reason, the real historical materialism needs an inductive method of knowledge. Only in that case historical materialism will cease to remain the soviet “histmat” and becomes the real form of a new world outlook. The author is of the opinion that the Party spirit of the Soviet philosophy promoted preservation of the anomalies mentioned in Marxism. The open discussion could help to find valid but not inherited from Hegel relation of historical and logical methods in Marxism. (shrink)

Business schools are frequently blamed for corporate ethical scandals by failing to develop integrity and critical ethical thinking skills in managers. What should business schools teach to address this? The paper proposes a framework for the development and evaluation of a business ethics curriculum, which is grounded on the AACSB learning goals of ethical understanding, reasoning abilities, managerial knowledge and ethical capacities. The framework is two building blocks in the form of tests, which together provide quality measures for business ethics (...) content and a definition of the scope and depth of knowledge an ethics curriculum should contain. Overall, the framework is a supplement to the AACSB guidelines and its purpose is to be a curriculum development tool. (shrink)
